As part of Mayor Brandon Johnson’s “Cut the Tape” initiative, we are excited to share the Zoning Board of Appeals’ more streamlined application and hearing process.

Rules Highlights:

  • All submitted applications will be made available on the ZBA website 2 weeks prior to their scheduled hearing.
  • All Interested Parties must register and submit written testimony 72 hours in advance of the ZBA meeting, which will then be posted online 48 hours prior to the ZBA meeting.
  • The Zoning Administrator’s Recommendations will be posted online 48 hours prior to the ZBA meeting.
  • Each hearing will be more abbreviated as all testimony will be required to be submitted and available ahead of time. After brief statements from the parties, the ZBA will be able to move straight to questioning and cross examination.

Forms Highlights:

  • User-friendly forms with clear instructions.
  • Applicants can provide digital signatures and forms no longer require notarization.
  • The new ZBA application consists of 1 completed filing: the required items in the “Checklist” and the “Public Hearing Packet”.
  • Separate affidavits are no longer required for each witness, Applicants will provide one comprehensive answer to each of the approval criteria and attribute the relevant parts to their witnesses.
  • Reformulation of the “Reasonable Return Analysis” for Variation Applications.
